What is Credit Card Fraud?

California Penal Code § 484g penalizes credit card fraud, and states that it is illegal to use a credit or debit card with intent to defraud to obtain good, services, or money where one knows the card to be fake, forged, expired, invalid, or belonging to someone else.

Penalties for Credit Card Fraud

Credit card fraud may be charged as a misdemeanor or felony. When the fraud results in receipt of goods valued at up to $950, it is charged as Petty Theft pursuant to California Penal Code § 484 and is punishable by up to six months in county jail. When the fraud results in receipt of goods valued at more than $950, it is charged as Grand Theft pursuant to California Penal Code § 487. If charged as a misdemeanor, Grand Theft is punishable by up to one year in county jail. If charged as a felony, Grand Theft is punishable by up to three years in state prison.
