False Personation

California Penal Code § 529 penalizes false personation, which is defined as using someone else’s name or identity to cause them harm or to gain an advantage unlawfully.
To make a case that a defendant committed false personation, a prosecutor must establish the following elements beyond a reasonable doubt:
(1) The defendant falsely impersonated someone in their public or private capacity; and
(2) While falsely impersonating, the defendant committed an additional act that created a liability for the victim or some benefit for the defendant.

Penalties for False Personation

Depending on the factual circumstances of each case, false personation may be charged as a misdemeanor or felony. To make such a determination, prosecutors consider several factors, such as the defendant’s criminal history, the magnitude of the offense at issue, and damages suffered by the victim, if any. A misdemeanor forgery charge is punishable by up to one year in county jail in addition to restitution, penalties, and fines. A felony forgery charge is punishable by up to three years in state prison, in addition to restitution, penalties, and fines.
